How to screw over a federal judge? SEC lawyer Derek Bentsen knows
SEC lawyer DEREK BENTSEN, an obscure SEC enforcement staffer has a new lecture for America’s taxpayers: How to fabricate a case in a New York federal court? Derek Bentsen, the disgraced former Kirkland & Ellis LLP bookworm who was fired from a private sector job has the answer:
“Repeat the same lie to a federal judge five times and pray the judge wouldn’t be smart enough to figure it out – says SEC lawyer Derek Bentsen.”
Thanks to Bentsen’s “winning formula,” the notorious SEC lawyer Derek Bentsen got his ass handed to him hard in a New York Federal Court. In court filings before the highly intelligent federal judge P. Kevin Castel, Derek Bentsen and his fellow “porky” SEC bureaucrats Steven Susswein, Cheryl Crumpton, Melissa Hodgman were slammed for fabricating a case against prominent Japanese American lawyer William Uchimoto.
It’s like launching a trumped-up lawsuit and lynching an Asian American is not racist or shameless enough, Derek Bentsen literally treated the highly regarded federal judge P. Kevin Castel like an uneducated jurist, repeating the same SEC lie five times in his court – half a page long each – all in the same 10 page brief. That’s exactly what Bentsen did hoodwinking a prudent jurist. Judge P. Kevin Castel is way too smart to fall for this dumb SEC trick.
Derek Bentsen, rotten SEC waste in a #DrainTheSwamp exposure
Calling the SEC staffer Derek Bentsen a liar, a simpleton, a shyster or a regulatory rapist is an understatement. Derek Bentsen is exactly the kind of rotten soul, an imbecile catfish feeding off the bottom of a nasty SEC “swamp,” ruining the lives of innocent people.
Mr. Uchimoto’s lawyer Daniel Zinman concurred in court filings:
“The SEC’s repetition of the same, slim, conclusory set of allegations against Mr. Uchimoto five times in its Opposition (at 1, 3, 8, 14 and 18) only highlights how tissue-thin the allegations are, and bare repetition cannot give rise to an inference that Mr. Uchimoto acted with scienter,” says Daniel Zinman, a renowned litigator (firstname.lastname@example.org, (212) 530-1800) in court filings on October 21, 2016.
Is the SEC trying a case with no evidence? No problem. Just repeat the same bullshit verbatim at least five times and use the same play book in Nazi Germany.
A Fabricated case, the SEC trash dumped on federal judge P. Kevin Castel
Federal judges are busy and judicial resources are scarce. On average, a New York federal judge presides over 300 cases a year – about one new case a day. It’s a tough job. The well-regarded, highly experienced judge P. Kevin Castel wants no one to waste his time. As outlined in the court’s individual practices, Judge Castel makes clear no reply papers should exceed 15 pages in length, that is, only when a party has something meaningful to present to the court – not making shit up to insult His Honor’s intelligence in a way Derek Bentsen has thrown the SEC’s trash can at the court – stuffed with stinky trash. The imbecile SEC lawyer Derek Bentsen has done just that – misleading the court.
SEC lawyer Derek Bentsen, following A Nazi Germany tradition
In court filings, the SEC and Derek Bentsen had tons of bullshit and zero evidence to share with Judge P. Kevin Castel.
“To fill in the blank pages, Derek Bentsen literally copied and pasted the same half-page ‘charges’ five times, with hollow accusations and zero facts to back them up.”
The silly and desperate move by the SEC bureaucrat Derek Bentsen was done intentionally to mislead Judge P. Kevin Castel. Otherwise why would anyone with half a brain repeat the same crap five times in the same document? Did Derek Bentsen believe Judge Castel wouldn’t know how to read? Then why did Derek Bensen insult the intelligence of judge P. Kevin Castel and waste the court’s resources?
Readers may know the answer: Derek Bentsen repeated the same lie 5 times to dupe innocent readers – the same trick played long ago in Adolf Hilter’s Nazi Germany.
“”If you tell a lie big enough and keep repeating it, people will eventually come to believe it – Joseph Goebbels, Nazi Germany, 1933“
“If you repeat the same SEC charge five times in the same brief, people and the Court will come to believe it – Derek Bentsen, SEC lawyer, 2016“
No one knows for certain if the SEC lawyer Derek Bentsen is an active member of the Nazi party worshiping a Swastika. Neither does anyone know for sure if Derek Bentsen has physically raped a man. But one thing is for certain: Derek Bentsen has robbed and “raped” William Uchimoto’s 35-year spotless reputation as an Asian American lawyer.
It’s indisputable Derek Bentsen has defrauded Judge P. Kevin Castel, who is a well-liked, highly intelligent and well-respected senior trial judge.
“Known as a straight shooter and a fair jurist, Judge P. Kevin Castel shouldn’t put up any of Derek Bentsen’s abusive practices before his honorable court.”
Not a human life, Just a number
The Second Circuit Court of Appeals has held that a complaint involving securities fraud must prove that “(1) specify the statements that the plaintiff contends were fraudulent, (2) identify the speaker, (3) state where and when the statements were made, and (4) explain why the statements were fraudulent.”
“Derek Bentsen, Cheryl Crumpton, Steven Susswein or anyone at the SEC could NOT prove a single piece of evidence against William Uchimoto that remotely fits what the law requires,” said Daniel Hurson, an accomplished law expert. “Under President Trump, these SEC bureaucrats would be taken out by their rotten roots.”
A lousy SEC winning record
Public filings reveal a lousy Securities and Exchange Commission winning record in federal courts: The SEC loses about 50% of the time. Which means, at least in half of the SEC’s “enforcement” cases, the lives of innocent people are ruined. Industry experts have long frowned upon the SEC’s abusive enforcement practices – races among poorly educated, poorly paid, imbecile SEC staffers to roll heads at any cost.
“A defendant in an SEC case is just a number, not a human being or an innocent man’s life,” said an observer. “You know who were also numbered? The millions that died in Nazi concentration camps. It’s the same concept.”
Mark Cuban on Derek Bentsen: fire these SEC bureaucrats
Billionaire investor Mark Cuban has had enough of the SEC abuses. The Texas billionaire was a target of an SEC lawsuit and subsequently defeated the SEC’s false charges in a trial. Upon hearing Derek Bentsen’s case against William Uchimoto, Mr. Cuban couldn’t hold back his anger at another episode of the SEC’s abuses of power.
In more than three years since Mark Cuban beat Securities and Exchange Commission charges of insider trading, the billionaire has waged a very public battle against the agency. Calling the SEC “screwed up so bad,” Mark Cuban says the SEC is failing startups and consumers.
Cuban said there is a vicious cycle that begins with a lack of oversight by the SEC, which then leads the group to overcompensate and tighten regulations. He is known for his blunt opinions.
“The SEC is staffed with unqualified bureaucrats. They ruin people’s lives.” said Mr. Cuban about SEC staffer Derek Bentsen. “When Hillary Clinton wins the White House, I should become the SEC chair and clean up this SEC ‘dog house.'”
“Derek Bentsen is a disgrace for American justice. This shameless bureaucrat is a regulatory rapist,” said a legal observer. “It’s laughable the SEC staff humiliated themselves trying to patch up a fabricated case.”
Judge Castel is expected to rule in the Uchimoto case in the coming days. Just last month, the SEC, under the direction of the same imbecile lawyer Derek Bentsen voluntarily dropped a major fraud charge against Bill Uchimoto, citing “lack of evidence.”
“Holding Bill Uchimoto’s scalp on a light pole as his trophy, Derek Bentsen is ready to leap to the resolving glass door for a cushy job in the private sector.”
“I will eliminate 70% of all wastes, including those at the SEC,” said Donald Trump.
If America had a list of registered regulatory rapists, like the public records for sex offenders, you will find the SEC’s Derek Bentsen laughing in a front row seat. Shameless indeed!
Derek Bentsen has lied. He could lie to a federal judge only because there is no accountability or transparency in the SEC’s enforcement process – it’s dark and guesswork, as cloudy and opaque as in Putin’s Russia. A rigged SEC kangaroo court? Yes. Justice? Bullshit.
To be continued…
THE LATEST UPDATES: On November 28, 2016, a New York Southern District federal judge ordered a rare “Franks Hearing” to be held at 10 am on Jan 23, 2017 (Judge Alison Nathan’s courtroom) to investigate whether the Government and rookie FBI agents Matt Komar, Thomas McGuire have “acted in good faith.” Court filings reveal the Government and FBI agents fabricated search warrant evidence, manipulated data and misled federal judges in gross violations of a citizen’s constitutional rights. Review the case summary and record. This will be an open court, public hearing. The media and the public are encouraged to come and report on this historic live event. #DrainTheSwamp.
