Melissa Hodgman, SEC enforcement: “When the facts don’t fit, we fix the facts”
MELISSA HODGMAN, an obscure mid-level Securities and Exchange Commission (SEC) “enforcement” bureaucrat was caught pants down lying and misleading the legendary New York federal judges P. KEVIN CASTEL and Judge Alison Nathan.
“JUDGE KEVIN CASTEL specifically found that the SEC had made no allegations whatsoever that Mr. Uchimoto had knowledge of any SEC alleged stock scheme, which was all made up,” said DANIEL ZINMAN, Mr. Uchimoto’s lawyer who’s led a RICHARDS, KIBBE & ORBE team that kicked MELISSA HODGMAN and her SEC co-conspirators’ fatty rear ends. “Melissa Hodgman was promoted to her current job, riding on Bill Uchimoto’s Asian scalp.”
DANIEL ZINMAN told the federal judge in court filings “The SEC’s repetition of the same, slim, conclusory set of allegations against Mr. Uchimoto five times only highlights how tissue-thin the allegations are, and bare repetition cannot give rise to an inference that Mr. Uchimoto acted with scienter.” Judge Kevin Castel agreed and got the SEC staff’s dumb fat asses handed to them.

Melissa Hodgman and her imbecile SEC mafia were so wrong about Bill Uchimoto that the Uchimoto family is in fact the epitome of American patriotism – a purple heart family, not law violators.

Bill Uchimoto’s father Dan Uchimoto is a famed American war hero, who is also a wounded veteran and the highest decorated Japanese American soldier in World War II – a patriot that risked his own life pulling hundreds of Jews out of concentration camps in Poland and Germany.

“If my father were still alive today, he would’ve fought back to expose the SEC fraudsters Melissa Hodgman, Steven Susswein, Patrick Feeney, Derek Bentsen, Jushua Braunstein and Cheryl Crumpton,” said William Uchimoto. “What Melissa Hodgman and the SEC did to me was racial profiling and un-American! William Uchimoto told New York Law Journal he had filed a motion with the SEC seeking sanctions against the agency and the enforcement division lawyers involved in the made-up case against him – MELISSA HODGMAN, DEREK BENTSEN, CHERYL CRUMPTON, STEVEN SUSSWEIN, PATRICK FEENEY, JOSHUA BRAUNSTEIN were outed as power abusers. Mr. Uchimoto confirmed that before the March 27 court ruling, he had planned to bring the sanctions motion before the court if the SEC didn’t withdraw its claims against him. “I was nothing but a pawn for Melissa Hodgman and the SEC,” said William Uchimoto.
“When they [SEC staff] screw up, they should be called to the carpet on it,” William Uchimoto said. “They [SEC staff] committed fraud against me; that’s how I look at it. It’s not even overzealous enforcement. It’s SEC fraud.”
Melissa Hodgman fabricated a Nasdaq listing rule, defrauded the DOJ, committed a crime
Touted by Melissa Hodgman and the SEC as a “Chinese cross border fraud,” the randy SEC staffer Melissa Hodgman ranted in a press release that Uchimoto – a former SEC lawyer and general counsel to the Philadelphia Stock Exchange – played a key role in a “market manipulation scheme” by misleading the $13 billion Nasdaq Stock Market, violating a so-called “Nasdaq 300 round lot gifting rule.” At the time of the alleged conduct in 2008, Bill Uchimoto was the esteemed Chairman of China Practices Group with global law firm Buchanan, Ingersoll & Rooney.
The truth is the Nasdaq never had a “300 round lot gifting rule.” It was a racist collusion between the Nasdaq and Melissa Hodgman’s SEC fraudsters that went after Uchimoto after he had testified to the SEC as a witness in 2013 against Nasdaq’s rigging of a listed company, which led to the SEC’s landmark reversal of Chinese company CleanTech Innovations’ wrongful delisting by the Nasdaq, reported by Forbes.
The Nasdaq delisting also triggered a well-publicized, massive racial discrimination lawsuit against the Nasdaq, led by the revered former U.S. Senator Arlen Specter. The Nasdaq retaliated, lied to the SEC and DOJ by making up a Nasdaq listing rule. Melissa Hodgman was eager to butter up the notorious Nasdaq general counsel Edward Knight to help her land a cushy job someday in the private sector. Uchimoto became the convenient sacrificial lamb and a “pawn” in a rigged SEC/Nasdaq collusion.
Meanwhile, MELISSA HODGMAN lied to the FBI and committed a crime that would send her to prison for some years.
GREG MILLER, Buchanan Ingersoll’s general counsel said he was pleased that a powerful federal judge has stamped down on the SEC abusers. “God bless America we have justice in a federal court,” Greg Miller told reporters. “If Mr. Uchimoto’s case had been brought before the SEC’s in-house administrative law judge, Melissa Hodgman’s lies and shady dealings would’ve been covered up.”
History shows the SEC loses more than 50% of its cases in federal courts because the zealous SEC folks lie a lot, repeated in the Uchimoto case.

Only five months into the highly publicized SEC case against William Uchimoto, prosecutors SARAH EDDY and MICHAEL FERRARA from the DOJ’s Southern District of New York (SDNY) grudgingly admitted in court filings they had been duped by the SEC and the Nasdaq.
There is “no rule prohibiting someone from gifting shares to others, not even in connection with a Nasdaq stock listing,” said the SDNY prosecutors SARAH EDDY, MICHAEL FERRARA in court filings in June 2016 – a position that directly contradicted Melissa Hodgman and the SEC’s fabricated Nasdaq listing rule – which was manipulated by Melissa Hodgman as the SEC’s only legal basis to implicate William Uchimoto.
Who has lied to the government, which is a crime? Melissa Hodgman, Edward Knight or others at the SEC and the Nasdaq? It’s a rotten case throughout. In response, the despicable Nasdaq general counsel Ed Knight vowed to nuke SEC Chair Mary Jo White. Uchimoto’s reputation was ruined. The case attracted coverage from both yellow journalists and the mainstream media.
A Rare Franks Hearing: Who’s lied? DOJ, the SEC or the Nasdaq?
DAVID MASSEY, a former SDNY prosecutor who was initially duped by Melissa Hodgman, Patrick Feeney, Steven Susswein and Cheryl Crumpton in 2011 to go after William Uchimoto, could hardly run away fast enough from Melissa Hodgman’s lies.

On January 23, 2017, a well-regarded New York federal judge held a “Franks Hearing” to examine the extent to which David Massey had colluded with rogue FBI agents MATT KOMAR, THOMAS MCGUIRE and lied to federal judges. Matt Komar is the same fraudulent FBI agent currently facing fraud charges for his lies told in a search warrant that has ruined finance mogul David Ganek, reported by the New York Times.
THOMAS MCGUIRE ((NY Bar registration #3020781) is another notorious FBI agent with a proven history of fabricating evidence and human rights violations, including a landmark case against him in United States v. Metter (2012) where Thomas McGuire illegally expanded a search warrant, and then lied to a federal judge to cover up his crime.
“The SEC and the Nasdaq told me about Nasdaq’s 300 shareholder listing rule,” David Massey confessed on the stand, under oath. “The SEC and the Nasdaq are the source for those lies. I have their emails and testimony to prove… I didn’t invent it. They did.”

David Massey joined law firm Richards, Kibbe & Orbe (“RK&O) and advised Bill Uchimoto’s lawyers DANIEL ZINMAN, ROWAN GAITHER, MARGARET MEYERS, STEPHANIE TSAY on how to expose Melissa Hodgman and her lies repeated by other SEC abusers.
Law firm RICHARDS, KIBBE & ORBE (RK&O) was quick to condemn MELISSA HODGMAN, taking credit for the court victory that has crushed Melissa Hodgman and the SEC’s manufactured case. In a glowing March 28, 2017 press release, RK&O lawyer Daniel Zinman scolded MELISSA HODGMAN and the SEC bureaucrats:
“Judge Castel specifically found that the SEC had made no allegations that Mr. Uchimoto had actual knowledge of anyone’s alleged stock scheme.” The SEC’s case against William Uchimoto was made up to claim Mr. Uchimoto’s Asian scalp in order to advance the shady careers of the SEC bureaucrats MELISSA HODGMAN, DEREK BENTSEN, STEVEN SUSSWEIN, PATRICK FEENEY, CHERYL CRUMPTON, JOSHUA BRAUNSTEIN.
In October 2016, riding on William Uchimoto’s scalp, MELISSA HODGMAN was promoted.
In announcing Hodgman’s $5,000 a year pay raise, the shameless Melissa Hodgman was touted in an SEC PR stunt as someone who’s built a record claiming scalps from “Chinese frauds.”
But neither Melissa Hodgman nor her SEC co-conspirators could utter a single Chinese phrase beyond “Kong Pao Chicken” off a Chinatown menu.
“Do these SEC idiots know Chinatown is not in China?” said Ronnie Chieng, a comedian and reporter who regularly appears on The Daily Show. “We have asked Melissa Hodgman and her staff to come on The Daily Show to explain their fabricated ‘market manipulation’ case against the Asians. Somehow the SEC folks all declined the invite. WFT are they hiding from?” The truth perhaps? The SEC didn’t respond to repeated requests for comment.
SEC Chairman Jay Clayton: put Melissa Hodgman, other SEC mad dogs on a leash
While Melissa Hodgman and the other SEC “enforcement” lawyers curiously “forgot” to check their own abusive power, the SEC’s bullshit press release announcing Melissa Hodgman’s promotion still cites the Uchimoto case as the ground for her pay raise.
Ironically, on the SEC’s website, Melissa Hodgman’s sadistic PR stunt is acutely placed next to an SEC press release that calls Bill Uchimoto a fraudster.
“Does the SEC or DOJ staff have a duty to be wise, informed and honest? Truth matters? ‘No!'”
Calls to the incoming SEC chairman Jay Clayton‘s cell phone and office lines were not immediately answered. Calls to his secretary at his office were referred to the SEC for further comments. Faxes were also sent to the SEC and Mr. Clayton’s office seeking comments. During a Senate confirmation hearing last month, Mr. Clayton pledged he would “scale back regulations and rein in regulatory abuses at the SEC.”
FOIA requests from several litigation law firms and media outlets were lobbed at the SEC’s FOIA office in late April 2017, seeking William Uchimoto’s Rule 11 sanctions motion against the named SEC staffers: MELISSA HODGMAN, DEREK BENTSEN, STEVEN SUSSWEIN, PATRICK FEENEY, CHERYL CRUMPTON, JOSHUA BRAUNSTEIN. It’s anticipated the historic sanctions motion will be broadly publicized.
Here’s a statement for Jay Clayton: “Mr. Clayton, for the sake of justice, these SEC power abusers must be neutered: MELISSA HODGMAN, DEREK BENTSEN, STEVEN SUSSWEIN, PATRICK FEENEY, CHERYL CRUMPTON, JOSHUA BRAUNSTEIN.”
