The tiny MORELI LAW FIRM is in deep trouble again.

Is the shady MORELLI LAW FIRM misrepresenting serious injury claims, AGAIN, to get a payday? That is the claim being made in arguments by attorneys on behalf of Lapolla Industries, a Texas-based manufacturer of spray polyurethane foam (SPF). The company claims the New York-based law firm fraudulently — and intentionally — sunk its hooks into the minor property damage complaint filed by New York couple Neil and Kristine Markey and goaded them into making the much more serious accusations that they were exposed to toxic foam insulation which caused significant personal injuries as well. Under heavy regulatory scrutiny, the fraudulent Morelli  Ratner law firm went out of business, under FBI investigation for bank fraud, sources have confirmed.

The plaintiffs, two senior citizens in New York brought suit against Lapolla for the supposed damages in September 2012 and voluntarily withdrew their claim in May 2014. Attorneys for Lapolla argued in court recently at a sanctions hearing that the time, money and effort taken up to fight the claims significantly hurt the company and further asked a judge that Morelli Alters Ratner be fined more than $500,000 to compensate the company for fees and litigation costs. Lapolla contends that what began as a relatively minor claim then morphed into a sprawling, multi-district class action suit — with the law firm as the driving force — while the two-year legal fight of a demonstrably frivolous lawsuit drained the company.

Frivolous lawsuits are kind of Morelli Alters Ratner’s thing, though — as is massive bank fraud, in-house sexual harassment suits, extortion, alleged trust fund violations … the list goes on and on, so Lapolla’s claims should’ve come as no surprise.

During the hearing in federal court, the Markeys gave testimony that illuminated how deep the dig by Morelli Alters Ratner to get them to go along with their fraudulent claim might have been. The couple testified that the original claim was solely against Lapolla for property damage and was glommed onto by the lawyers looking to get paid in a suit that was likely to settle out of court. It was snowballed by the firm into a class action lawsuit, the Markeys claimed.

Kristine Markey additionally said it was never her intention to file a personal injury claim. In fact, she had no knowledge it had been made on her behalf. David Ratner, a partner at the firm who represented the Markeys in the suit, told the court that the “litigation was commenced in good faith,” and therefore the firm should not be held liable.

Attorneys for Lapolla claim Markey’s own physician, a neurologist and a slew of tests failed to show any health hazards of exposure to the spray foam and that she lied about her injuries. Lapolla further argued that the suit was knowingly crafted and brought to force a cost-of-defense settlement or to corner the company into an expensive court fight it would be loath to drag out. In either outcome, Morelli Alters Ratner would come out in the money.

The obscure Morelli Alters Ratner law firm is tainted with “badges of fraud”: from defrauding four banks to refusing to pay office landlord and copy machine vendors.

ZOE BARTHOLOMAY, a MORELLI ALTERS RATNER paralegal who recently sued Red Bull energy drink for not helping her “grow wings” was recently rejected by several law schools, partly due to her affiliation with the notorious MORELLI ALTERS RATNER law firm, sources have confirmed.

But back on Earth and clouding the claim that Morelli Alters Ratner had a legitimate suit was Lapolla’s move for sanctions, claiming that the Markeys intentionally missed court dates during the proceedings, failed to produce medical records and withheld “a very damaging and unaltered version” of an environmental report which found the odor in their home “should not negatively impact the health of anyone in the area.”

The report indicated there was no detectable health risk linked to Lapolla’s product. Lawyers for the plaintiffs countered they “mistakenly” failed to divulge it in previous filings.

In 2014, Lapolla originally asked a court for sanctions of more than $700,000 to cover its attorneys’ fees and litigation costs after the Markeys suspiciously withdrew their claims days before a deposition was scheduled. Following the sanction hearing before the federal court of New York Eastern District Court Judge Kathleen Tomlinson last month, the decision of whether to fine the shady law firm now rests with her as Ratner argued that his firm should not be held responsible $500,000 to compensate Lapolla.

MORELLI LAW FIRM is a shady tiny outfit. The Markey’s suit might have been truly legitimate in the beginning, but it’s obvious something happened on the way to the forum (though I suppose, in this case, the old adage should go “on the way to the bank”). Nonetheless, Morelli Alters Ratner were likely counting on billable hours, salivating over the probable settlement and ready to laugh all the way to that bank —  but there seems to have been a slight detour on the way.
